1. YOUR RELATIONSHIP WITH GO FINANCIAL AID
1.1 Your use of Go Financial Aid Services is subject to the terms of a legal agreement between you and Go Financial Aid. Go Financial aid’s principal place of business is at 350 Hastings Street, Pittsburgh, PA 15206, United States. This document explains how the agreement is made up, and sets out the terms of that agreement.
1.2 Unless otherwise agreed to in writing with Go Financial Aid, your agreement with Go Financial Aid will always include, at a minimum, the terms and conditions set out in this document (the “Universal Terms”).
1.3 Your agreement with Go Financial Aid will also include the terms of any Legal Notices applicable to the Services, in addition to the Universal Terms (referred to as “Additional Terms”). Where Additional Terms apply to a Service, these will be accessible for you to read either within, or through your use of, that Service.
1.4 The Universal Terms, together with the Additional Terms, form a legally binding agreement between you and Go Financial Aid in relation to your use of the Services. It is important that you take the time to read them carefully. If you do not understand these Terms, you should seek consultation from an attorney. Collectively, this legal agreement is referred to below as the “Terms”.
1.5 If there is any contradiction between what the Additional Terms say and what the Universal Terms say, then the Additional Terms shall take precedence in relation to that Service.
2. ACCEPTING THE TERMS
2.1 In order to use the Services, you must first agree to the Terms. You may not use the Services if you do not accept the Terms.
2.2 You can accept the Terms by either:
(A) clicking to accept or agree to the Terms, where this option is made available to you by Go Financial Aid in the user interface for any Service; or
(B) by actually using the Services. In this case, you understand and agree that Go Financial Aid will treat your use of the Services as acceptance of the Terms.
2.3 You may not use the Services and may not accept the Terms if (a) you are not of legal age to form a binding contract with Go Financial Aid, or (b) you are a person barred from receiving the Services under the laws of the United States or other countries including the country in which you are resident or from which you use the Services.
2.4 Before you continue, you should print a copy or save a local copy of the Universal Terms for your records.
3. PROVISION OF THE SERVICES BY GO FINANCIAL AID
3.1 Go Financial Aid may have subsidiaries or affiliated legal entities (“Subsidiaries and Affiliates”). Sometimes, these companies will be providing the Services to you on behalf of Go Financial Aid. You acknowledge and agree that Subsidiaries and Affiliates will be entitled to provide the Services to you.
3.2 You acknowledge and agree that the form and nature of the Services which Go Financial Aid provides may change from time to time without prior notice to you.
3.3 You acknowledge and agree that Go Financial Aid may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally at Go Financial Aid’s sole discretion, without prior notice to you. You may stop using the Services at any time.
3.4 You acknowledge and agree that if Go Financial Aid disables access to your account, you may be prevented from accessing the Services, your account details, or any Content which is contained in your account.
4. USE OF SERVICES BY YOU
4.1 In order to access certain Services, you may be required to provide information about yourself (such as identification or contact details) as part of the registration process for the Service, or as part of your continued use of the Services. You agree that any registration information you give to Go Financial Aid will always be accurate, correct and up to date.
4.2 You agree to provide Go Financial Aid with accurate personal information, demographic information, financial information, and other data used in accordance with the Services.
4.3 You agree to use the Services only for purposes that are permitted by (a) the Terms and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.
4.4 You agree not to access (or attempt to access) any of the Services by any means other than through the interface that is provided by Go Financial Aid, unless you have been specifically allowed to do so in a separate agreement with Go Financial Aid. You specifically agree not to access (or attempt to access) any of the Services through any automated means (including use of scripts or web crawlers) and shall ensure that you comply with the instructions set out in any robots.txt file present on the Services.
4.5 You agree that you will not engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services).
4.6 You agree that you will not reproduce, duplicate, copy, sell, trade or resell the Services for any purpose to any person or company at any time, unless you have been specifically permitted to do so by Go Financial Aid in writing.
4.7 You agree that you are solely responsible for (and that Go Financial Aid has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which Go Financial Aid may suffer) of any such breach.
5. YOUR CONDUCT ON THE SITE
5.1 Our Site is private property. All interactions on this Site must be lawful and must comply with these Terms. To the extent your conduct (as judged by us in our sole discretion), restricts or inhibits any other user from using or enjoying any part of this Site, we may limit your privileges on the Site and seek other remedies.
5.2 PLEASE DO NOT DO ENGAGE IN ANY OF THE FOLLOWING ACTIVITIES, they are prohibited on the Site and constitute express violations of this Agreement:
- Submitting any purposely inaccurate information, committing fraud or falsifying information in connection with your Go Financial Aid account or in order to create multiple Go Financial Aid accounts;
- Attempting to, or actually accessing data not intended for you, such as logging into a server or an account which you are not authorized to access;
- Attempting to scan, or test the security or configuration of the Site or to breach security or authentication measures without proper authorization;
- Tampering or interfering with the proper functioning of any part, page or area of the Site and any and all functions and services provided by Go Financial Aid;
- Attempting to interfere with service to any user in any manner, including, without limitation, by means of submitting a virus to our Site, or attempts at overloading, “flooding”, “spamming”, “mail bombing” or “crashing” the Site;
- Using the Site or any of its contents to advertise or solicit, for any other commercial, political or religious purpose, or to compete, directly or indirectly with Go Financial Aid;
- Reselling or repurposing your access to the Site;
- Using the Site or any of its resources to solicit Site End Users or other business partners of Go Financial Aid to become users or partners of other online or offline services directly or indirectly competitive or potentially competitive with Go Financial Aid, including without limitation, aggregating current or previously offered deals;
- Using any End User information from the Site for any commercial purpose, including, but not limited to, marketing; or
- Acting illegally or maliciously against the business interests or reputation of Go Financial Aid, any of our partners, or our Services.
6. YOUR PASSWORDS AND ACCOUNT SECURITY
6.1 In order to access certain services, you may be required to provide current, accurate identification, contact, and other information as part of the registration process and/or continued use of Go Financial Aid services. You agree and understand that you are responsible for maintaining the confidentiality of your account password, and are responsible for all activities that occur under your account and through the use of the Services.
6.2 Accordingly, you agree that you will be solely responsible to Go Financial Aid for all activities that occur under your account.
6.3 You agree to immediately notify Go Financial Aid of any unauthorized use of your password or account or any other breach of security. Go Financial Aid cannot and will not be liable for any loss or damage arising from your failure to provide us with accurate information or to keep your password secure.
6.4 If you become aware of any unauthorized use of your password or of your account, you agree to notify Go Financial Aid immediately at email@example.com.
7. PRIVACY AND YOUR PERSONAL INFORMATION
7.2 You agree to the use of your data in accordance with Go Financial Aid’s privacy policies.
8. CONTENT IN THE SERVICES
8.1 You understand that all information (such as personal information, financial information, demographic information, website articles, blog articles, or other data), collectively referred to as “Content”, which you may have access to as part of, or through your use of, the Services are the sole responsibility of the person from which such content originated.
8.2 You should be aware that Content presented to you as part of the Services may be protected by intellectual property rights which are owned by the sponsors or advertisers who provide that Content to Go Financial Aid (or by other persons or companies on their behalf). You may not modify, rent, lease, loan, sell, distribute or create derivative works based on this Content (either in whole or in part) unless you have been specifically told that you may do so by Go Financial Aid or by the owners of that Content, in a separate agreement.
8.3 You acknowledge and agree that any Content that you provide to Go Financial Aid is true and accurate to the best of your knowledge, and that you have the right to provide Go Financial Aid with this Content. Go Financial Aid makes no warranty as to the accuracy of any content that is provided by you, including any information that may be related to financial aid applications.
9.1 Go Financial Aid is committed to providing users of its site with as many features as possible. Accordingly, Go Financial Aid may contract, license, or otherwise work with other companies (“Partners”) to deliver the Services.
9.2 The Partners that Go Financial Aid selects may offer products and services that site visitors may find useful. Go Financial Aid in certain cases may have a business relationship with certain third parties that it selects as a partner.
9.3 Go Financial Aid is not responsible for the accuracy or reliability of any advice or information given, or of any statement made, by Partners, or for the content, services, products, or advertising on or available from their Web sites, or for the availability and operations of their Web sites.
10. AVAILABILITY OF THE SITE
10.1 You acknowledge that there may be interruptions in service or events that are beyond our control. While we use reasonable efforts to keep the Site accessible, the Site may be unavailable from time to time for any reason including, without limitation, routine maintenance.
10.2 You understand and acknowledge that due to circumstances both within and outside of our control Site access may be interrupted, suspended or terminated. Go Financial Aid retains the right at our sole discretion to deny service, or access to the Site to anyone or an account, at any time and for any reason.
11. TRANSMISSION OF INFORMATION
11.1 You acknowledge and agree that because Go Financial Aid does not control the security of the Internet or other networks you use to access the Site or communicate with us, we can’t be, and are not responsible for, the security of information that you choose to communicate with Go Financial Aid and the Site while it is being transmitted.
11.2 You acknowledge and agree that Go Financial Aid is not responsible for any data lost during transmission.
12. PROPRIETARY RIGHTS
12.1 You acknowledge and agree that Go Financial Aid (or Go Financial Aid’s licensors) own all legal right, title and interest in and to the Services, including any intellectual property rights which subsist in the Services (whether those rights happen to be registered or not, and wherever those rights may exist). You further acknowledge that the Services may contain information which is designated confidential by Go Financial Aid and that you shall not disclose such information without Go Financial Aid’s prior written consent.
12.2 Unless you have agreed otherwise in writing with Go Financial Aid, nothing in the Terms gives you a right to use any of Go Financial Aid’s trade names, trademarks, service marks, logos, domain names, and other distinctive brand features.
12.3 If you have been given an explicit right to use any of these brand features in a separate written agreement with Go Financial Aid, then you agree that your use of such features shall be in compliance with that agreement, any applicable provisions of the Terms, and Go Financial Aid's brand feature use guidelines as updated from time to time. 12.4 You agree that you shall not remove, obscure, or alter any proprietary rights notices (including copyright and trade mark notices) which may be affixed to or contained within the Services.
12.5 Unless you have been expressly authorized to do so in writing by Go Financial Aid, you agree that in using the Services, you will not use any trade mark, service mark, trade name, logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of such brand features.
13. LICENSE FROM GO FINANCIAL AID
13.1 Go Financial Aid gives you a personal, worldwide, non-assignable and non-exclusive license to use the software provided to you by Go Financial Aid as part of the Services as provided to you by Go Financial Aid (referred to as the “Software” below). This license is for the sole purpose of enabling you to use the benefit of the Services as provided by Go Financial Aid, in the manner permitted by the Terms.
13.2 You may not (and you may not permit anyone else to) copy, modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract the source code of the Software or any part thereof, unless this is expressly permitted or required by law, or unless you have been specifically told that you may do so by Go Financial Aid, in writing.
13.3 Unless Go Financial Aid has given you specific written permission to do so, you may not assign (or grant a sub-license of) your rights to use the Software, grant a security interest in or over your rights to use the Software, or otherwise transfer any part of your rights to use the Software.
13.4 The Software which you use may automatically download and install updates from time to time from Go Financial Aid. These updates are designed to improve, enhance and further develop the Services and may take the form of bug fixes, enhanced functions, new software modules and completely new versions. You agree to receive such updates (and permit Go Financial Aid to deliver these to you) as part of your use of the Services.
14. EXCLUSION OF WARRANTIES
14.1 NOTHING IN THESE TERMS, INCLUDING SECTIONS 14 AND 15, SHALL EXCLUDE OR LIMIT GO FINANCIAL AID’S WARRANTY OR LIABILITY FOR LOSSES WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR CONDITIONS OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR LOSS OR DAMAGE CAUSED BY NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF IMPLIED TERMS, OR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, ONLY THE LIMITATIONS WHICH ARE LAWFUL IN YOUR JURISDICTION WILL APPLY TO YOU AND OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
14.2 YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK AND THAT THE SERVICES ARE PROVIDED "AS IS" AND “AS AVAILABLE.”
14.3 IN PARTICULAR, GO FINANCIAL AID, ITS SUBSIDIARIES AND AFFILIATES, AND ITS LICENSORS DO NOT REPRESENT OR WARRANT TO YOU THAT:
(A) YOUR USE OF THE SERVICES WILL MEET YOUR REQUIREMENTS,
(B) YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR FREE FROM ERROR,
(C) YOUR USE OF THE SERVICES WILL RESULT IN A YOUR EXPECTED OR REQUESTED OUTCOME IN RECEIVING FINANCIAL AID,
(D) ANY INFORMATION OBTAINED BY YOU AS A RESULT OF YOUR USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE, AND
(E) THAT DEFECTS IN THE OPERATION OR FUNCTIONALITY OF ANY SOFTWARE PROVIDED TO YOU AS PART OF THE SERVICES WILL BE CORRECTED.
14.4 ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR OTHER DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
14.5 NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM GO FINANCIAL AID OR THROUGH OR FROM THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.
14.6 GO FINANCIAL AID FURTHER EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
15. LIMITATION OF LIABILITY
15.1 SUBJECT TO OVERALL PROVISION IN PARAGRAPH 14.1 ABOVE, YOU EXPRESSLY UNDERSTAND AND AGREE THAT GO FINANCIAL AID, ITS SUBSIDIARIES AND AFFILIATES, AND ITS LICENSORS SHALL NOT BE LIABLE TO YOU FOR:
(A) ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL CONSEQUENTIAL OR EXEMPLARY DAMAGES WHICH MAY BE INCURRED BY YOU, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY. THIS SHALL INCLUDE, BUT NOT BE LIMITED TO, ANY LOSS OF PROFIT (WHETHER INCURRED DIRECTLY OR INDIRECTLY), ANY LOSS OF GOODWILL OR BUSINESS REPUTATION, ANY LOSS OF DATA SUFFERED, COST S ASSOCIATED WITH LOSS OF FINANCIAL AID, COSTS OF ATTENDING COLLEGE, COSTS OF RECEIVING STUDENT LOANS AND OTHER FINANCIAL AID, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR OTHER INTANGIBLE LOSS;
(B) ANY LOSS OR DAMAGE WHICH MAY BE INCURRED BY YOU, INCLUDING BUT NOT LIMITED TO LOSS OR DAMAGE AS A RESULT OF:
(I) ANY RELIANCE PLACED BY YOU ON THE COMPLETENESS, ACCURACY OR EXISTENCE OF ANY ADVERTISING, OR AS A RESULT OF ANY RELATIONSHIP OR TRANSACTION BETWEEN YOU AND ANY ADVERTISER OR SPONSOR WHOSE ADVERTISING APPEARS ON THE SERVICES;
(II) ANY CHANGES WHICH GO FINANCIAL AID MAY MAKE TO THE SERVICES, OR FOR ANY PERMANENT OR TEMPORARY CESSATION IN THE PROVISION OF THE SERVICES (OR ANY FEATURES WITHIN THE SERVICES);
(III) THE DELETION OF, CORRUPTION OF, OR FAILURE TO STORE, ANY CONTENT AND OTHER COMMUNICATIONS DATA MAINTAINED OR TRANSMITTED BY OR THROUGH YOUR USE OF THE SERVICES;
(III) YOUR FAILURE TO PROVIDE GO FINANCIAL AID WITH ACCURATE ACCOUNT INFORMATION;
(IV) YOUR FAILURE TO KEEP YOUR PASSWORD OR ACCOUNT DETAILS SECURE AND CONFIDENTIAL;
15.2 THE LIMITATIONS ON GO FINANCIAL AID’S LIABILITY TO YOU IN PARAGRAPH 15.1 ABOVE SHALL APPLY WHETHER OR NOT GO FINANCIAL AID HAS BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING.
16.1 We will make every reasonable effort to resolve any disagreements that you have with Go Financial Aid. If those efforts fail, by using this Site you agree that any claim, dispute, or controversy you may have against Go Financial Aid arising out of, relating to, or connected in any way with the Services shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) and conducted before a single arbitrator pursuant to the applicable Rules and Procedures established by AAA (“Rules and Procedures”).
16.2 You agree further that: (a) the arbitration shall be held at a location determined by AAA pursuant to the Rules and Procedures (provided that such location is reasonably convenient for you), or at such other location as may be mutually agreed upon by you and Go Financial Aid; (b) the arbitrator shall apply Illinois law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (c) there shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only your and/or Go Financial Aid’s individual claims; and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (d) in the event that you are able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Go Financial Aid will pay as much of your filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (e) with the exception of subpart (c) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the Rules and Procedures established by AAA, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (c) is found to be invalid, unenforceable or illegal, then the entirety of this Arbitration Provision shall be null and void, and neither you nor Go Financial Aid shall be entitled to arbitrate their dispute.
17.1 You agree to defend, indemnify and hold harmless Go Financial Aid, its subsidiaries, affiliates and their respective directors, officers, employees and agents from and against all claims and expenses, including attorneys’ fees, arising out of or related to any products or services purchased by you in connection with the Site or any use of the Site in violation of these Terms.
17.2 You are solely responsible for your interactions with Partners and other users of the Site. To the extent permitted under applicable laws, you hereby release Go Financial Aid from any and all claims or liability related to any product or service of a Partner, any action or inaction by Partner, including Partner’s failure to comply with applicable law and/or failure to abide by the terms of a Go Financial Aid, and any conduct or speech, whether online or offline, of any other user.
18. CHOICE OF LAW
19. COPYRIGHT AND TRADEMARKS
19.1 Everything located on or in this Site and in our Services is the exclusive property of Go Financial Aid or is being used with permission. ANY COPYING, DISTRIBUTING, TRANSMITTING, POSTING, LINKING, DEEP LINKING, OR OTHERWISE MODIFYING OF THIS SITE OR ANY OF THE SITE OR CONTENT WITHOUT THE EXPRESS WRITTEN PERMISSION OF GO FINANCIAL AID IS PROHIBITED. Any violation of this requirement may result in a copyright, trademark or other intellectual property right infringement that may subject you to civil and/or criminal penalties.
19.2 The Site contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound, and the entire contents of the Site are protected by copyright as a collective work under the United States copyright laws. Go Financial Aid owns a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it.
19.3 You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part. Except as otherwise expressly stated under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material without the express permission of Go Financial Aid or the copyright owner is permitted. If copying, redistribution or publication of copyrighted material is permitted, you will make independent attribution and/or agree to make no changes in or deletion of any author attribution, trademark legend or copyright notice.
19.4 You acknowledge that you do not acquire any ownership rights by downloading copyrighted material.
20. COPYRIGHT POLICY AND DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) PROCEDURES
20.1 Go Financial Aid reserves the right to terminate its agreement with you or any other End User who infringes third-party copyrights.
20.2 If you believe that any material has been posted via the Site by an End User in a way that constitutes copyright infringement, you shall provide Go Financial Aid with the following information: (a) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyrighted work; (b) an identification of the copyrighted work and the location on the Site of the allegedly infringing work; (c) a written statement that you have a good faith belief that the disputed use is not authorized by the owner, its agent, or the law; (d) your name and contact information, including telephone number and e-mail address; and (e) a statement by you that the above information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner’s behalf.

21. CHILDREN’S ONLINE PRIVACY PROTECTION ACT
21.1 No one under the age of 13 should provide any personal information. In general, Go Financial Aid does not knowingly collect personally identifiable information from children under 13.
21.2 If in limited circumstances we do knowingly collect personally identifiable information from children under the age of 13, we will do so only with verified parental consent prior to collection.
21.3 In the event that we learn that we have collected information from a child under the age of 13 without verification of parental consent, we will delete this information from our database as quickly as possible.
21.4 If you believe the Web site has any information about anyone under 13, please contact us at email@example.com.
22.1 Some of the Services are supported by advertising revenue and may display advertisements and promotions.
22.2 The manner, mode and extent of advertising by Go Financial Aid on the Services are subject to change without specific notice to you.
22.3 In consideration for Go Financial Aid granting you access to and use of the Services, you agree that Go Financial Aid may place such advertising on the Services.
23. OTHER CONTENT
23.1 The Services may include hyperlinks to other web sites or content or resources. You acknowledge and agree that Go Financial Aid may have no control over any web sites or content or resources which are provided by companies or persons other than Go Financial Aid.
23.2 You acknowledge and agree that Go Financial Aid is not responsible for the availability or content of any such external sites or resources, and does not endorse any products, advertising, or other materials on or available from such web sites.
23.3 You acknowledge and agree that Go Financial Aid is not liable or responsible for any loss or damage which may be incurred by you as a result of the availability or content of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such web sites or resources.
24. CHANGES TO THE TERMS
24.1 Go Financial Aid may make changes to the Universal Terms or Additional Terms from time to time. When these changes are made, Go Financial Aid will make a new copy of the Universal Terms available at http://www.gofinancialaid.com/terms-and-conditions.html and any new Additional Terms will be made available to you from within, or through, the affected Services.
24.2 You understand and agree that if you use the Services after the date on which the Universal Terms or Additional Terms have changed, Go Financial Aid will treat your use as acceptance of the updated Universal Terms or Additional Terms.
25. GENERAL LEGAL TERMS
25.1 Sometimes when you use the Services, you may (as a result of, or through your use of the Services) use a service or download a piece of software, or purchase goods, which are provided by another person or company. Your use of these other services, software or goods may be subject to separate terms between you and the company or person concerned. If so, the Terms do not affect your legal relationship with these other companies or individuals.
25.2 The Terms constitute the whole legal agreement between you and Go Financial Aid and govern your use of the Services, and completely replace any prior agreements between you and Go Financial Aid in relation to the Services.
25.3 You agree that Go Financial Aid may provide you with any notices, including those regarding changes to the Terms, by email, regular mail, or postings on the Services.
25.4 You agree that if Go Financial Aid does not exercise or enforce any legal right or remedy which is contained in the Terms (or which Go Financial Aid has the benefit of under any applicable law), this will not be taken to be a formal waiver of Go Financial Aid’s rights and that those rights or remedies will still be available to Go Financial Aid.
25.5 If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and enforceable.
25.6 You acknowledge and agree that each member of the group of companies of which Go Financial Aid is the parent shall be third party beneficiaries to the Terms and that such other companies shall be entitled to directly enforce, and rely upon, any provision of the Terms which confers a benefit on (or rights in favor of) them. Other than this, no other person or company shall be third party beneficiaries to the Terms.
25.7 The Terms, and your relationship with Go Financial Aid under the Terms, shall be governed by the laws of the State of California without regard to its conflict of laws provisions. You and Go Financial Aid agree to submit to the exclusive jurisdiction of the courts located within the county of Santa Clara, California to resolve any legal matter arising from the Terms. Notwithstanding this, you agree that Go Financial Aid shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.
26. ENDING YOUR RELATIONSHIP WITH GO FINANCIAL AID
26.1 The Terms will continue to apply until terminated by either you or Go Financial Aid as set out below.
26.2 If you want to terminate your legal agreement with Go Financial Aid, you may do so by (a) notifying Go Financial Aid at any time and (b) closing your accounts for all of the Services which you use, where Go Financial Aid has made this option available to you. Your notice should be sent, in writing, to Go Financial Aid’s at 350 Hastings Street, Pittsburgh, PA 15206.
26.3 Go Financial Aid may at any time, terminate its legal agreement with you if:
(A) you have breached any provision of the Terms (or have acted in manner which clearly shows that you do not intend to, or are unable to comply with the provisions of the Terms); or
(B) Go Financial Aid is required to do so by law (for example, where the provision of the Services to you is, or becomes, unlawful); or
(C) the partner with whom Go Financial Aid offered the Services to you has terminated its relationship with Go Financial Aid or ceased to offer the Services to you; or
(D) Go Financial Aid is transitioning to no longer providing the Services to users in the country in which you are resident or from which you use the service; or
(E) the provision of the Services to you by Go Financial Aid is, in Go Financial Aid’s opinion, no longer commercially viable.
26.4 Nothing in this Section shall affect Go Financial Aid’s rights regarding provision of Services under Section 3 of the Terms.
26.5 When these Terms come to an end, all of the legal rights, obligations and liabilities that you and Go Financial Aid have benefited from, been subject to, or which have accrued over time, or which are expressed to continue indefinitely, shall be unaffected by this cessation, and the provisions of paragraph 25.7 shall continue to apply to such rights, obligations and liabilities indefinitely.
